How is property divided?
In Manitoba, in 99% of cases, property is divided equally between the parties, and each get 50% of the total family property.
What if my spouse didn't contribute?
If property was acquired during a relationship, it doesn't matter who paid for something, it is equally shared by both parties. It doesn't matter if your partner refused to contribute, or if you didn't want your partner to purchase something - everything acquired during your relationship (with some limited exceptions) is shareable.
What property is not included?
Some property is not included in the property division, including:
1. Inheritances
2. Gifts
3. Assets acquired prior to the relationship
However, if you have placed any of these assets into joint names with your spouse, or into your spouse's name, they will be shareable.
