Will, Power of Attorney and Health Care Directive

Estate package (will, power of attorney and health care directive) for one person:    $600.00

Estate package (will, power of attorney and health care directive) for a couple:  $1,000.00

In some circumstances, you may require only one of the documents. We generally recommend that all three be prepared, but individual fees are as follows:

Will: $400.00

Power of Attorney: $225.00

Health Care Directive: $100.00

Probating or Administering an Estate

Fees and disbursements for probating or administering an estate are governed by the Queen’s Bench Rules and in particular, rule 74.14.

Basic legal fees are based on the value of the estate and calculated as follows:

• 3% on the first $100,000, or the portion of that amount, of the total value of the estate, subject to a minimum fee of $1,500;

• 1.25% on the next $400,000, or the portion of that amount, of the total value of the estate;

• 1% on the next $500,000, or the portion of that amount, of the total value of the estate;

• 0.5% on the total value of the estate over $1,000,000.

There may be adjustments to the amount of the fees based on the complexity of the estate, and your lawyer can discuss these with you more fully.

Probate fees have been eliminated by the Province of Manitoba effective November 6, 2020.

Disbursements associated with probating or administering an estate are generally moderate, with the average disbursements totaling less than $200.00.
